NRA Brief in Appeal on NSA Mass Surveillance

On March 13, I filed a “friend of the court” brief on behalf of the National Rifle Association in the ACLU’s appeal of this case to the Second Circuit U.S. Court of Appeals. ¬†The brief updates the NRA’s original arguments in the trial court, where the NRA’s brief was filed before new documents confirmed the existence of the NSA’s location tracking program.

Unfortunately, the Second Circuit brief was filed before I learned about the latest study confirming that gun owners can easily be identified through telephone metadata.  Fortunately, that study is covered (along with many others) in an excellent brief by a group of top computer scientists.
